1. Competition Rules

1.1 The subject of this document is a complete and clear regulation of the Rules (hereinafter referred to as the "Rules") of the promotional event "Competition for Novesta Star Master sneakers" (hereinafter referred to as the "Competition"). These Rules are the only document that binds the Rules of the Competition as set out in the promotional material to consumers. These Rules may only be amended by written amendments to this document published in the same manner as this document.
1.2 The provisions of these Rules shall take effect on the date of their publication on the website www.gonovesta.com. These Rules shall be deemed to be the sole and complete rules for the purposes of the Competition.
1.3 The Competition is a promotional competition which is not a gambling competition. The purpose of the Competition is to raise public awareness and to promote products from the Organiser's portfolio.

 

2. Date and place of the Competition

2.1 The Competition shall run from 11 March 2024 to 8 April 2024, namely until 12:00 AM (the "Competition Period").

 

3. Participation in the Competition

3.1 Only a natural person over the age of 18 years who is not disqualified from the Competition pursuant to Article 6.8 of these Rules below, and who registers to enter the Competition in the manner set out in Article 3.2 of these Rules below, may enter the Competition.
3.2 Participants enter the Competition by sending their photos with Novesta sneakers to news@gonovesta.com during the Competition Period.
3.3 Participants are only eligible to enter the Competition once.
3.4 Only those Participants who meet all the set conditions of the Competition and perform the task in a proper and complete manner as described in Article 3.2 will be entered into the competition and may become winners. The Organiser shall have the right to assess at any time whether individual Participants have met the set conditions of the Competition.
3.5 Participation in the Competition is voluntary and the Participant is obliged to respect these Rules and to act in accordance with good manners, in particular participation in the spirit of fair play. The use of unfair or deceptive practices, circumvention of these Rules or attempted abuse of these Rules to obtain a prize is unacceptable. Any violation of this policy will entitle the Organiser to immediately disqualify the relevant Participant from the Competition. If it turns out that this person is a winner despite the above, he/she will forfeit his/her claim to the prize.

 

4. Competition prizes, competition process, winner determination mechanism

4.1 The six winners of the Novesta Star Master sneakers of their choice will be determined by a consecutive draw. No part of the prize can be paid in cash.
4.2 Only a Participant who has met all of the entry requirements required by these Rules at the time of the Competition may become a winner of the Competition. In the event that the winner drawn proves to be ineligible to win under these Rules for any reason whatsoever, the Organiser will draw another winner from amongst the participants who have met all the conditions of entry required by these Rules at the time of the competition.
4.3 The Organiser shall be entitled to check all conditions for participation in the Competition and reserves the right to make the final decision as to whether or not the conditions set out for participation in the Competition and for the prize in question have been met. A prize may not be awarded to Participants who have not even partially fulfilled the conditions set out for the prize in question. The draw will be made by random selection from the email addresses of the Participants who have entered the Competition. The draw will be made by the Organiser using an automated system. The winners will be contacted by email to the email address from which the Competition photographs were sent. The results of the Competition are final with no possibility of revocation.
4.4 There is no legal claim to the prizes from the Competition, and no claim to the prize can be transferred to any other person or to any other Participant. The Organiser reserves the right to substitute declared prizes with prizes of a similar type of equivalent value and to change the terms and conditions for the awarding of prizes.
4.5 Any complaints shall be finally decided by the Organiser. Any complaints or grievances regarding the Competition and its conduct may be sent to the Organiser at news@gonovesta.com at any time during the Competition Period, but no later than three (3) working days after the end of the Competition. If a dispute arises between the Organiser and a Participant, the parties undertake to use their best endeavours to resolve the dispute amicably.

 

5. Handing over the prizes to the winners

5.1 The Organiser will contact the Winner by email no later than ten (10) working days after the Competition has been judged and invite the Winner to provide their address for sending the prize by post or courier service. The Organiser will contact the winner a maximum of two times. If the winner fails to respond to any of the Organiser's attempts within three (3) working days of the last attempt, the winner will no longer be eligible to receive the prize; thereafter, such winner's prize shall be forfeited without compensation to the Organiser, who shall be entitled to use it for the purpose of redrawing the prizes. The Organiser shall not be liable for failure to notify a prize in the event of a change in a winner's telephone number or email address, unless such change has been duly and timely notified to the Organiser by the Participant. The Organiser is not responsible for the functionality of mobile operators' networks.
5.2 The Organiser further reserves the right to exclude from the Competition any Participant who is reasonably suspected of committing fraudulent or dishonest acts or acts contrary to good morals which are capable of influencing the results of the Competition, including through third parties. The Organiser reserves the right not to award or hand over the prizes in the event of any breach of the Competition Rules by the winner or any action on the part of the Participants which would be contrary to good manners.
5.3 If the winner rejects the prize, the prize will be forfeited without compensation to the Organiser, who is entitled to award the prize to the next Participant in the order of these Rules, or to use it for other marketing or charitable purposes.
5.4 The prize will be delivered to the winner by post or courier no later than one (1) month after the end of the Competition. In the case of sending the prize by post or courier, the delivery slip or the acceptance report will serve as proof of sending the prize and the winner is obliged to sign it. Any prize not claimed by the winner shall be forfeited without compensation to the Organiser, who shall be entitled to use it for the purpose of redrawing the winners. The Organiser shall not be liable for non-delivery of the prize in the event of a change of residence of the winner, if this change has not been duly and timely notified by the winner, as well as in the event of the absence of the winner at the address notified by the winner, or for loss, damage, destruction or non-delivery of the prize or its delivery after the deadline set out in these Rules caused by the post office or any other carrier of parcels. The Winner is fully responsible for the accuracy of the information provided and the Organiser is not responsible for non-delivery of the prize due to incomplete or incorrect information provided by the Winner. The Organiser will not be liable for non-delivery of the prize if sent by post or courier and will not be liable for any loss or damage to the prize in transit. All claims, if any, must be made within two (2) months of receipt of the prize.
5.5 Participants who do not receive any of the prizes will not be notified in any way.
5.6 The Organiser accepts no responsibility for the use or application of the prize by the winner.

 

6. Final Provisions

6.1 The Organiser is not responsible for any technical problems in the transmission of data via the internet or other electronic means.
6.2 By participating in the Competition, the Participant agrees to the Competition Rules and undertakes to comply fully with them. The rights and obligations arising in connection with the Competition, which are not regulated in these Rules, are governed by the laws of the Slovak Republic.
6.3 The Organiser reserves the right to amend or modify the Competition Rules or to limit, postpone or cancel the Competition at any time without giving reasons and to provide for refunds, as well as to substitute individual prizes for other prizes of a similar type and corresponding value in justified cases or in cases of special consideration. Any changes to the Rules of the Competition, cancellation of the Competition and substitution of individual prizes for other prizes will be made in writing and published on www.gonovesta.com
6.4 It is not possible to enforce participation in the Competition and the prize by legal proceedings or to pay monetary or non-monetary compensation in lieu of the prizes in kind and the Participant is not entitled to claim an exchange of the prizes in kind, to claim the prizes in any way, or to claim any rights of defective performance in relation to the prizes received. The Organiser shall also not be liable for any damage that the Participants may suffer as a result of their participation in the Competition or through the prize won.
6.5 By submitting photographs to the Competition, the Participant agrees that, in the event of winning the Competition, visual or audio-visual recordings of his/her person may be made and subsequently published in the media and in the promotional material of the Competition Organiser, together with the name and surname of the winner, details of the prize and the value of the prize. The Participant shall not be entitled to any remuneration in connection with the creation and subsequent publication of visual or audiovisual recordings of his/her person and waives any financial or other pecuniary claims which he/she has incurred or may incur in this respect.
6.6 By entering the Competition, the Participant agrees to the processing of the personal data provided to the extent specified in the registration and, in the case of a prize, also the data about the prize and its value, the address of the winner to which the prize is to be delivered, the winner's image or audiovisual recordings that the Organiser obtains from the Participant during or after the Competition (hereinafter referred to as "Personal Data") by the Organiser as administrator and to their possible processing by a processor for the purposes of organising this Competition, the determination of the recipients of the prizes and, in the case of a prize won by a Participant, for the purposes of tax administration and the publication of the results of the Competition in the media and in the Organiser's promotional materials, for the period necessary for the organisation of the Competition, the termination of the Competition, the settlement of claims arising from the Competition and any control by public authorities.
6.7 Personal Data will be processed automatically in electronic form. The provision of Personal Data is voluntary and the consent to processing may be withdrawn at any time free of charge by contacting the Organiser, any future controller or the Organiser (in the event of withdrawal of consent to processing, the relevant Personal Data will be erased or otherwise destroyed), that he/she has the right of access to his/her Personal Data (including information on the scope and purpose of processing and any available information on its source) and the right to rectification of such data, completion, blocking of incorrect Personal Data, its destruction, etc. In case of doubt that the processing of Personal Data is contrary to the protection of the private or personal life of the Participant or contrary to the law, the Participant may ask the Organiser, any future controller or the Organiser for an explanation and immediate rectification of the situation, or may contact the Data Protection Authority directly.
6.8 All employees of the Organiser, former employees of the Organiser for a period of three (3) months from the termination of employment with the Organiser, natural persons otherwise cooperating with the Organiser in the organisation of the Competition and persons close to all of the aforementioned persons are excluded from the Competition. In the event that a person so excluded becomes a winner, the Organiser will award the prize to the next Participant in the order of these Rules. In the event that the winner is a disqualified person and that disqualified person has already taken the prize, the prize is not validly won and the winner is obliged to return the prize immediately upon the written request of the Organiser or to reimburse the Organiser for the full value of the respective prize.
6.9 By entering the Competition, the Participant agrees that the Organiser or its designee shall be entitled to publish, free of charge, the Participant's expressions of a personal nature (photographs submitted to the Competition, video, writing, voice, slogan, etc.), on the Internet, in promotional materials or in the media and on the Organiser's products, for a period of at least one (1) year from the date of creation of these entries, and for the Organiser's internal purposes without limitation.
6.10 These full Rules are published on the Competition website www.gonovesta.com. In the event of any conflict between the text of the abbreviated Rules set out in any promotional material presenting this Competition and these full Rules published on the Competition Site, these full Rules shall prevail.
6.11 In the event of any disputes arising out of or in connection with this Competition, the individual Participant and the Organiser agree to resolve them by mutual negotiation and agreement as a matter of priority.
